Role:


We’re seeking a sharp, business-minded Business Affairs Counsel to support our marketing, content, and brand teams. You’ll play a key role in advising on advertising and promotional matters, social media campaigns, influencer relationships, strategic partnerships, and brand IP usage. You will spend considerable time drafting and addressing contracts to support these business units, reviewing content intended for widespread publication, and counseling your teammates around these areas.
This role is ideal for someone who thrives in a fast-paced, consumer-facing environment, possesses considerable applicable experience, and can balance risk while enabling creativity and growth. You must offer a relevant, well-developed skill set, and you must be prepared to hit the ground running.
This role reports to our General Counsel and works closely with marketing, communications, creative, and product teams.The ideal candidate is comfortable working through ambiguity, meticulous in their attention to detail, self-motivated, resourceful, and capable of independently producing excellent work product. As an early member of our team, your contributions will play a critical role in shaping the future of Function Health as we strive to scale from a burgeoning startup to a household brand.

Key Responsibilities:


  • Serve as legal advisor to the marketing, content, brand, and partnerships teams across a variety of channels (digital, social, email, print, paid media, influencer, and more).
  • Review and advise on marketing materials, campaigns, scripts, and claims for compliance with applicable laws and regulations (FTC, FDA, state advertising laws, etc.).
  • Draft, negotiate, and manage agreements including influencer and creator contracts, marketing agency MSAs, content licenses, sponsorship deals, and talent releases.
  • Partner cross-functionally to advise on IP usage, endorsements, testimonial content, brand collaborations, and promotional offers.
  • Help establish scalable marketing and content review workflows, including pre-clearance processes and risk-tiering frameworks.
  • Support content creation policies and compliance for consumer-facing materials, including health-related communications.
  • Stay current on evolving marketing and advertising regulations, platform policies, and industry trends.

Qualifications/Skills:


  • J.D. from an accredited law school; active bar membership in at least one U.S. jurisdiction.
  • 5+ years of relevant legal experience, including at least 2 years in-house at a consumer brand, media, or tech company.
  • Deep understanding of advertising and consumer protection laws (e.g., FTC Act, CAN-SPAM, TCPA, COPPA, NAD), especially with respect to health-related messaging.
  • Experience negotiating marketing, sponsorship, influencer, and creative production contracts.
  • Familiarity with health, wellness, or life sciences marketing is a strong plus.
  • Strong commercial instincts, with a balanced, pragmatic approach to legal risk.
  • Exceptional written and verbal communication skills, with a clear and concise style.
  • Ability to operate autonomously and collaboratively in a fast-moving environment.

Great-to-Have Skills and Experiences:


  • Experience advising on health claims, FDA/FDA-compliant content, or health-related disclaimer.
  • Familiarity with content licensing, SAG-AFTRA/union matters, or AI-generated content guidelines.
  • Background in media, consumer tech, or wellness/healthcare sectors.
