Work Arrangement:
***This position is available as fully remote or hybrid, depending on the location to the Sioux Falls, SD office.***
The Vice President Fintech Counsel provides legal and compliance support to The Bancorp’s Fintech Solutions team and other business units, with a dual focus on credit products (e.g., consumer, commercial, leasing, commercial real estate lending, and Earned Wage Access), and deposit-related Fintech and payment products. This role partners closely with business and regulatory teams to deliver practical, risk-based legal guidance aligned with strategic goals. Reports to the Managing Director, Deputy General Counsel, Fintech Strategies. Preferred location is Sioux Falls, SD; remote work considered.

Education/Experience Requirements
- Juris Doctor (JD) from an accredited law school.
- Active license to practice law in good standing.
- 5–8 years of relevant legal experience in a law firm or in-house legal department within the financial services industry.
- Proven ability to partner with business teams across organizational levels to support strategic and operational goals.
Preferred Qualifications
- Strong knowledge of laws and regulations impacting consumer and commercial lending, deposit products, and depository institutions, including Regulation Z, Regulation B, Regulation E, Regulation DD, Regulation M FCRA, UCC Article 9, FDIC disclosures, state money transmission laws, the Military Lending Act, and SCRA.
- Familiarity with payment systems and network rules such as Visa, Mastercard, ACH, RTP, and FedNow, as well as emerging fintech models including Earned Wage Access, Buy-Now-Pay-Later (BNPL), and credit sponsorship.
- Understanding of commercial banking laws and regulatory frameworks, with the ability to conduct legal research and apply business, legal, and regulatory principles to provide sound guidance.
- Proven ability to interact with senior executives, regulators, business partners, and external counsel, and to communicate effectively both verbally and in writing.
- Highly professional, dependable, and discreet in managing confidential information, with a demonstrated ability to work independently and collaboratively in a dynamic, fast-paced environment.
- Proficient in Microsoft Office (Excel, PowerPoint, Word, Outlook) with the ability to manage shifting priorities, meet deadlines, and produce accurate work under time constraints; willingness to support The Bancorp’s Core Values and travel as needed to locations including Sioux Falls, SD and Wilmington, DE.

Salary Range: $120,000 - $184,000
